Foreclosure Process
A property becomes subject to foreclosure whenever a tax amount becomes three full years delinquent. Visit our Property Tax Foreclosure page for more information.
Example: 2022 tax year – Taxes become fully delinquent on May 16, 2023. In May of 2026, any Real Property owing 2022 (or earlier) taxes becomes subject to the 2026 foreclosure process.

Surplus Funds and HB2089
House Bill 2089 brings Oregon into compliance with the 2023 U.S. Supreme Court ruling in Tyler v. Hennepin County, which held that local governments cannot retain surplus proceeds from a tax foreclosure above what is owed in taxes and fees. HB 2089 ensures homeowners can recover any remaining equity.
