The foregoing restriction does not prevent you from selling an API Client or a license thereto.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE API AND ITS DATA IS AT YOUR SOLE RISK AND THAT THE API AND ITS DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY TYPE OR NATURE, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY THAT THIS API OR ITS DATA IS FREE FROM DEFECTS. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE, LOSS OF DATA, OR ANY OTHER DAMAGE OR INJURY HOWEVER CAUSED, RESULTING FROM YOUR USE OF THE API OR ITS DATA.

MULTNOMAH COUNTY SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE API OR ITS DATA, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE), OR ANY OTHER PECUNIARY LOSS, WHETHER OR NOT MULTNOMAH COUNTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
