Terms pertaining to use of api.multco.us:

Multnomah County’s api.multco.us API (the “API”) allows a developer to include in their web page or application information regarding when any of Multnomah County’s four drawbridges – the Hawthorne, Morrison, Burnside, and the Broadway bridge – commence the process of raising their platform.

You may use the API and the data it broadcasts in connection with your website or software application (an “API Client”) only in accordance with the terms and conditions published here and in our Privacy Policy (currently located at https://multco.us/privacy-policy).

You agree to: (a) prominently place in your API client the following notice: “This product uses an API published by Multnomah County but is not endorsed or certified by Multnomah County”; (b) display to your users a notice stating that by using the API they agree to the terms and conditions published on multco.us governing use of the API; and (c) notify your users that Multnomah County disclaims any possible warranties and all liability associated with use of the API.

Multnomah County may monitor your use of the API to ensure quality, improve our services, and verify your compliance with these terms. You acknowledge and agree that Multnomah County may collect and use technical data from you about your API Client, device, system(s), and application software. Other than the information you submit to Multnomah County to gain access to the API, Multnomah County will not collect data from you allowing you to be personally identified. You shall not interfere with such monitoring or otherwise obscure your use of the API.

You agree not to use the API for the following commercial uses: the sale of the API, its data, or related services, or access to any of the foregoing; or the sale of advertising, sponsorships, or promotions. The foregoing restriction does not prevent you from selling an API Client or a license thereto.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE API AND ITS DATA IS AT YOUR SOLE RISK AND THAT THE API AND ITS DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY TYPE OR NATURE, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY THAT THIS API OR ITS DATA IS FREE FROM DEFECTS. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE, LOSS OF DATA, OR ANY OTHER DAMAGE OR INJURY HOWEVER CAUSED, RESULTING FROM YOUR USE OF THE API OR ITS DATA.

MULTNOMAH COUNTY SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE API OR ITS DATA, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE), OR ANY OTHER PECUNIARY LOSS, WHETHER OR NOT MULTNOMAH COUNTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL MULTNOMAH COUNTY BE LIABLE TO YOU FOR ANY AMOUNT.

TO THE EXTEND PERMITTED BY LAW, YOU AGREE TO INDEMNIFY AND HOLD HARMLESS MULTNOMAH COUNTY, ITS OFFICIALS AND EMPLOYEES, AND ANY PERSON, FROM AND AGAINST ALL CLAIMS, LIABILITIES, LOSSES, CAUSES OF ACTION, DAMAGES, JUDGMENTS, AND EXPENSES, INCLUDING THE REASONABLE COST OF ATTORNEYS’ FEES AND COURT COSTS, FOR INJURIES OR DAMAGES TO THE PERSON OR PROPERTY OF THIRD PARTIES, INCLUDING, WITHOUT LIMITATIONS, CONSEQUENTIAL DAMAGES AND ECONOMIC LOSSES, THAT ARISE OUT OF OR IN CONNECTION WITH YOUR USE OF THE API OR ITS DATA.
