Remand Hearing on Portland Water Bureau's Land Use Application (video, 5:48:00)
Post Hearing Information
The County held the Portland Water Bureau’s Remand Hearing on Wednesday, April 16, 2025.
Approximately 122 people attended the hearing in person at the East County Health Center in Gresham
and approximately 198 people attended virtually. Testimony was taken from all people who chose to
speak for or against the proposal. The hearing was limited in scope to resolving the issue(s) remanded by
the Oregon Land Use Board of Appeals in Cottrell Community Planning Organization et al v. Multnomah
County, LUBA No. 2023-086 concerning the criterion of approval at MCC 39.7515(B).
The Hearings Officer issued a Letter outlining the deadlines for the post-hearing periods as set at
the public hearing:
- May 5, 2025 at noon: Open record period
- May 8, 2025 at noon objections to materials filed during open record period
- May 19, 2025 at noon: Responsive record period–– all evidence and arguments must be a
response to materials filed after April 16, 2025 and by May 8, 2025; no new issues or evidence- May 22, 2025 at noon – deadline for objections to materials filed during responsive record
period
- May 22, 2025 at noon – deadline for objections to materials filed during responsive record
- May 27, 2025 at noon: Opponents’ and County staff’s final argument; final argument must be
based on information in the record- May 30 at noon – deadline for objections to inclusion of new evidence in final argument of
opponents and/or County staff
- May 30 at noon – deadline for objections to inclusion of new evidence in final argument of
- June 3, 2025 at noon: Applicant’s final argument; final argument must be based on information
in the record- June 6, 2025 at noon – deadline for objections to inclusion of new evidence in final
argument
- June 6, 2025 at noon – deadline for objections to inclusion of new evidence in final
- June 25, 2025: Hearings Officer’s Decision
