Portland Water Bureau was approved to build a filtration facility on SE Carpenter Lane and associated pipelines. The Decision has been remanded by the Oregon Land Use Board of Appeals.

Remand Hearing Date And Time: Wednesday, April 16, 2025 at 9am

In-Person Location: East County Health Center, 600 NE 8th Street, Gresham, Oregon, in the Sharron Kelley Room

After registering, you will receive a confirmation email containing information about joining the hearing. During registration, you will be asked if you want to testify. People who do not sign up in advance to testify will be given an opportunity at hearing to indicate that they want to testify.

Scope Of Hearing: This hearing is limited in scope to resolving the issue(s) remanded by the Oregon Land Use Board of Appeals in Cottrell Community Planning Organization et al v. Multnomah County, LUBA No. 2023-086 (PDF, 9mb) concerning the criterion of approval at MCC 39.7515(B). Statements or evidence outside of such scope may be deemed inapplicable, inadmissible, and/or not warranting further consideration. For this hearing, the existing record of statements and evidence in this matter is before the Hearings Officer and new evidence and statements may be offered for admission into the record.

Current Status

Portland Water Bureau applied for and was approved to build a drinking water filtration facility and communications tower located at the eastern end of SE Carpenter Road, with raw and finished water pipelines connecting to the existing Bull Run conduit system.

On January 22, 2025 the Land Use Board of Appeals (LUBA) remanded the County Hearings Officer’s decision back to the county for review.

No party asked the Oregon Court of Appeals to review the LUBA decision by the February 12, 2025 deadline. As of February 14, 2025, the Portland Water Bureau has begun to wind down the active construction of the Bull Run Filtration project.

On February 25, 2025, the Portland Water Bureau requested that the county proceed with the remand.

The county will hold a remand hearing. A Notice of Public Hearing was mailed on March 25, 2025.
